In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include— (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

Science and scholarship thrives on free exchange among academics. The Fulbright program is predicated upon “learning and empathy between nations through educational exchange”. Yet international exchange can also have perverse consequences in an era of populism, resurgent nationalism and economic austerity. A battle is occurring between the European Union and Hungarian Government over the government’s back-sliding from the EU’s core values of democracy, rule of law and freedom of speech. This battle was triggered by the legislative attack on foreign universities. When academic freedom is undefended, no higher education institution can be fully protected from the wave of nationalist authoritarian politics that is sweeping the world. 1991 Fulbright Postgraduate Scholar to Georgetown University. Diane is a Centenary Professor in the Institute of Governance and Policy Analysis at the University of Canberra. She is also a Professor at Warwick University and Vice President of the International Public Policy Association. From 2004 to 2008, she was a European Commission Marie Curie Chair and founding Professor of Public Policy at Central European University (CEU) in Budapest. She has been a Board member of the Think Tank Fund, Network of the Open Society Foundation and was on the Governing Body of an international organisation – the Global Development Network. On 25 June 2014, the Foreign Minister, the Honourable Julie Bishop MP, hosted the New Colombo Plan 2014 Scholarships Presentation Dinner at the Department of Foreign Affairs and Trade in Canberra. The Governor-General, His Excellency General the Honourable Sir Peter Cosgrove AK MC (Retd), and Minister Bishop presented forty scholarships to undergraduate students to study and undertake internships in Japan, Indonesia, Singapore or Hong Kong. Of the forty scholarship award winners, four were announced as Fellows: Emma Roberts (Yudhoyono Fellow, Indonesia); Jason Emmanuelle (Kishi Fellow, Japan); Rebecca Wardell (Singapore Fellow) and Sarah Mitchell (Hong Kong Fellow). Transcript: PETER VARGHESE: Good evening to all of you. I'd like to extend a very warm welcome to each and every one of you and thank you for joining us here this evening at the Department of Foreign Affairs and Trade for this very important New Colombo Plan occasion. So, Governor-General, it's a great privilege to have you here this evening and can I invite you to say a few words. [Applause] PETER COSGROVE: Well, I jumped at the opportunity when the Foreign Minister invited me to become patron of the New Colombo Plan. I think it's a terrific initiative that is violently important to Australia's future. To seize the opportunities, our young people must be able to speak other languages, understand other cultures, build friendships and cultivate contacts. So, to those men and women, I congratulate you all on being selected as the inaugural scholarship recipients. [Applause] UNIDENTIFIED FEMALE SPEAKER: We'll now hear from the Prime Minister of Australia. TONY ABBOTT: This is a great occasion. You and your success will change our country and our region forever. Your experiences will add to Australia, add to growth, add to friendships in the region and add to the depth that's already been demonstrated in your lives. JULIE BISHOP: I want to acknowledge the students, the first wave of New Colombo Plan scholars who will leave Australia and you are now part of the inaugural alumni. We want this to be a rite of passage, we want this to be an opportunity for Australian undergraduates at all of our universities to be able to be part of the New Colombo Plan. It's about having young Australians living and studying and working in the region, not only gaining an extraordinary educational experience for themselves for their study will be recognised by their home university, but it's giving them an opportunity to form friendships and networks and connections and understandings that, hopefully, will last a lifetime. I hope our New Colombo Plan scholars will be the leaders of the future in politics, in government, in business, in communities, in families across Australia and beyond. Of those 40 students this evening, four have been selected as Fellows. The Yudhoyono Fellow for 2014 is Emma Roberts. [Applause] The 2014 Kishi Fellow is Jason Emmanuelle.
